Bayer had hoped they wouldn’t face another trial over the cancer link to Roundup herbicide until February but an elderly couple in California may change that.
A husband and wife, both in their 70s, are invoking the same California law, which gives scheduling preference to people who are terminally ill. The same law allowed Dewayne Johnson, a school groundskeeper diagnosed with just months to live, to stage the first Roundup trial this summer, resulting in a $289 million verdict in his favor.
While there are some 9,500 people, and counting, who blame their cancer on Bayer’s new acquisition, Monsanto, the couple wants their case to go to court in December “before they die.”
In related news, U.S. District Judge Vince Chhabria in San Francisco, who is handling all the Roundup cases in federal court, said he wants to schedule the first four trials for the spring of 2019.
Since the verdict in the DeWayne Johnson trial, Bayer’s stock price has plunged 15 percent.
